Father took blame — and prison — for fatal hit-and-run - Milwaukee Journal Sentinel

Silva has been in prison more than a year for a crime he didn't commit. The costly ruse, which one of Silva's attorneys characterized as something out of Shakespeare, ended Thursday when prosecutors filed new charges against the 22-year-old son, also named Juan G. Silva. The next day, the then-43-year-old Silva went to a police station and said he had faulty windshield wipers and he remembered hitting something, essentially turning himself in. He eventually pleaded guilty in court to hit-and-run involving death... But Thursday, 22 months after the crash and more than a year after the father's sentencing, prosecutors charged the son with the crime. The elder Silva's trial attorney, Thomas R. Jones, said he did not know of the new charges until informed by the Milwaukee Journal Sentinel on Thursday. Jones said his former client could face new charges related to obstructing justice but he would hope prosecutors would just dismiss the whole matter "and attribute it to a father's love for his son. A hearing is set for Monday, when prosecutors will seek to dismiss the case against the older Silva. Source: www.jsonline.com
